About us

These terms govern your use of fysik.com and your purchase of FYSIK products.

Using this website

All content on this site — text, photography, drawings, product designs, the FYSIK name and logo, and our product names — belongs to FYSIK or is used with permission. You may not copy, republish or redistribute it for commercial purposes without our written consent.

Catalogues, specification sheets, drawings and 3D files are provided for the purpose of specifying and purchasing FYSIK products. You may use them in your own design and construction documents. You may not resell them, present them as your own, or use them to manufacture or commission competing products.

Product specifications, finishes, dimensions and availability may change. Photographs and renderings are illustrative; natural materials vary. Nothing on this site constitutes a binding offer.

Enquiries, quotations and orders

Most FYSIK products are made to order. The ordering process is:

  1. You send us an enquiry describing what you need.
  2. We respond with a written quotation covering products, finishes, quantities, price, lead time and delivery terms.
  3. A quotation is valid for 30 days, and does not constitute a contract.
  4. An order is confirmed when we receive your written acceptance and the required deposit.

Once production of a made-to-order item has begun, the order cannot be cancelled or amended except by written agreement with us.

Prices

Prices are those stated in your quotation. Published price lists are indicative and may change without notice.

Unless expressly stated in writing, prices do not include transport, customs duty, import tax, delivery, special handling, storage, insurance or assembly. You are responsible for reporting and paying any taxes, duties, fees or charges arising from the purchase, shipment, delivery, installation, storage or use of the products.

Payment

Unless otherwise agreed, made-to-order items require a 50% deposit to confirm the order, with the remaining 50% due on completion and before shipment.

Payment is made by bank transfer or by card via a payment link, in the currency stated in your quotation. Card payments are processed by our payment provider. We do not collect, see or store your card details.

Products remain the property of FYSIK until payment has been received in full.

Delivery

Our standard delivery term is Delivered At Place (DAP): we deliver the goods to the named destination, and you are responsible for unloading and customs clearance. DDP and EXW terms are also available by agreement, and will be stated in your quotation. The carrier is not obliged to bring goods indoors, upstairs, or to unpack them. White glove delivery can be arranged in advance for an additional fee.

Delivery dates are estimates unless we have confirmed them in writing. Partial deliveries are permitted. Risk of loss or damage passes to you when the products are delivered.

If delivery cannot be completed because the products do not fit through an entrance, because you are not present at the agreed time, or because you refuse delivery, you will bear the costs of any subsequent transfer, restocking, storage and redelivery.

Inspection and acceptance

Please check your delivery without delay. Notify us in writing within fourteen (14) days of delivery of any incorrect delivery, missing part, or defect that reasonable inspection would reveal. After that period, the delivery is deemed accepted, other than for claims under the warranty below.

Retain the affected product and its original packaging for inspection.

Warranty

We warrant that the material and workmanship of our products will conform to our published specifications for two (2) years from the date of delivery. The warranty does not cover:

  1. Surface conditions, normal wear and tear, neglect, accidents, damage in transit, abuse, or improper maintenance or storage
  2. Damage resulting from assembly, repair or alteration by anyone other than FYSIK or a person authorised by us, or from use contrary to our instructions
  3. Minor deviations in construction, colour or material from published specifications
  4. Natural variation in the colour, grain or texture of wood, leather or metal
  5. Matching or compatibility of colour or texture, unless expressly agreed in writing

If a product is defective, we will repair or replace it at our option. If we determine it cannot be repaired or replaced within a reasonable time, you will receive a price reduction or, for serious defects, a refund. These are your exclusive remedies for breach of warranty.

Returns and cancellation

Made-to-order products are manufactured to your specification and cannot be returned or exchanged because you have changed your mind. This does not affect your rights where a product is defective.

For stock items, contact us within 14 days of delivery to arrange a return. Products must be unused and in their original packaging, and return shipping is at your cost.

If you are a consumer in the EU or UK: the statutory right to withdraw from a distance contract within 14 days does not apply to goods made to your specification or clearly personalised. It does apply to unpersonalised stock items.

Limitation of liability

Our liability for any claim — whether in contract, tort (including negligence), or otherwise — shall not exceed the purchase price of the product giving rise to the claim.

We are not liable for consequential, indirect, special, punitive or incidental damages, or for lost profits, whether foreseeable or not. Some jurisdictions do not permit these exclusions, in which case they may not apply to you in full.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be limited.

Your statutory rights

If you are a consumer, nothing in these terms affects your statutory rights under the law of your country of residence. Where those rights conflict with any provision here, your statutory rights prevail.

Indemnity

You agree to indemnify FYSIK, its affiliates, partners and their respective directors, officers, employees and agents against any claims, losses, expenses, damages and liabilities arising from:

  1. A product being subjected to accident, misuse, neglect, alteration, unauthorised relocation, improper repair or maintenance, or removal of safety devices
  2. A product being installed, maintained or used contrary to our instructions
  3. Any change made to FYSIK trademarks on a product

This does not apply to matters caused solely by defects in our materials or workmanship, or by our sole negligence.

Force majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, strikes or other labour disputes, disruption of operations, natural disasters, war, epidemics, government acts or orders, or transport failures.
